I, (The Member/Participant), hereby acknowledge and agree to the terms and conditions outlined in this Liability Waiver and Participant Agreement (the “Agreement”) with The Cold Plunge Co. Limited trading as The Cold Plunge Co. Recovery Lounge Recovery Lounge (hereinafter referred to as “The Cold Plunge Co.” or “we”).
Participant’s Responsibilities:
- I acknowledge that I will not use the facilities under the influence of alcohol or drugs (including any prescription drugs causing drowsiness or unconsciousness).
- I certify that I do not have any communicable or infectious skin conditions, disorders, or diseases, large cuts, open sores, or wounds.
- I will shower thoroughly before entering the ice bath, ensuring all oils, creams, or makeup are removed from my body.
- I confirm that I do not have kidney disease.
- I certify that I do not suffer from epilepsy or chronic heart disease, or if I do, my use of the ice bath has been approved by a medical physician in writing.
- I confirm that I am not pregnant, do not suffer from diabetes or low blood pressure, or if I do, my use of ice baths has been approved by a medical physician.
- I acknowledge that I do not have a medical condition, and I am not medicated in any manner, which may be adversely affected by cold water immersion.
- I understand that I will not use the ice bath if I have incontinence and will not voluntarily or involuntarily release bodily fluids of any kind while inside the ice bath.
I confirm that I have not:
- Had any chemical processing or permanent dye of my hair within the past 2 weeks.
- Had my hair subject to Keratin treatment in the last 4 weeks.
- Used any Henna products in the last 4 weeks.
- Used spray, lotion, or any other fake tanning products in the past 7 days.
- Had any semi-permanent dyes used in my hair (must wait until fully washed out).
- I confirm that I do not currently have hair extensions.
- I understand that shaving or waxing 24 hours before entering the ice bath can sting or irritate my skin.
- I certify that I am not currently cytotoxic and will not use the ice bath while undergoing any cytotoxic treatment (e.g., Chemotherapy). I will check with my medical physician to see how long I must wait until I am no longer cytotoxic.
- I agree to use great caution while entering and exiting the ice bath and during the entire time I am in the facility. I understand there is a risk of wet and slippery surfaces.
- I understand that the ice bath is not discarded/drained between each dip but is filtered, sanitized, and recycled, and that our ice baths are inspected between every single dip.
Financial Responsibility:
- I understand that if I breach the Dip Terms or otherwise contaminate the water of the ice bath, I will be financially responsible for draining and replacing the water and special cleaning services (up to $1,000).
Cancellation Policy:
- We require at least 24 hours’ notice for cancellations or rescheduling to accommodate other customers.
- Less than 24 hours’ notice will result in a charge of the full value of the booking unless agreed on by staff or within the booking tab/app. Failure to provide any notice (No Show) will incur a charge of the full value of the booking.
Liability Waiver:
- I, (the participant), have voluntarily elected to participate in the ice bath services and related activities offered by The Cold Plunge Co. Recovery Lounge.
- I acknowledge that these activities include being submerged in water within a semi-enclosed space, as described above, and I understand the risks involved.
- In consideration for being allowed to participate in the Activities, I hereby release The Cold Plunge Co., its officers, employees, contractors, organizers, sponsors, and any other persons involved in my participation (collectively, the “Releasees”) from any liability for personal injury, death, or loss or damage to personal property arising from or related to my participation in the Activities, whether caused by the negligence of any Releasee or otherwise.
- I agree to indemnify and hold harmless each Releasee from any demand, claim, or proceeding arising out of my participation in the Activities, including any breach of the Dip Terms.
- I certify that I have no injuries, physical or mental restrictions, disabilities, or predispositions to sickness or injury that may affect my participation in the Activities.
- I further certify that I am not under the influence of alcohol or any drug that may affect my participation in the Activities, my safety, or the safety of others.
Additional Clauses:
Acknowledgment of Risks: I acknowledge that participation in the ice bath services and related activities carries inherent risks, including but not limited to, the risk of injury, illness, or death. I voluntarily assume all such risks associated with my participation.
Equipment Safety: I agree to use any provided equipment, including safety rails or grips, properly and as instructed by The Cold Plunge Co. staff. I understand that failure to do so may increase the risk of injury.
Photography/Videography Release – I grant The Cold Plunge Co. the irrevocable and unrestricted right to use and publish photographs or videos of me taken during my participation in the Activities for marketing, promotional, and educational purposes, without compensation or approval rights. (Our staff will always ask for permission in person prior to taking photos or videos and you can always say no. This release clause only applies in the cases that you do verbally agree. If you were ever not asked, please do let our team members know if you would like the material to be deleted.)
Staff Supervision: I acknowledge that I am responsible for following all staff instructions and guidelines provided by The Cold Plunge Co. staff during my participation in the Activities. I understand that failure to do so may result in the termination of my session without refund. Staff are trained cold water immersion coaches and have undergone first-aid training.
I have read this Agreement, understand its terms, and voluntarily agree to be bound by its terms and conditions.
